Bring Your Own Model (BYOM) & External Model Policy

For commissions where the client provides their own model or links to an external model that is not featured in G3 C&M's roster, G3 C&M will only accept and use such models if they are in full compliance with Creative Commons licensing, intellectual property rights, copyright law, copyleft provisions, and all other applicable laws.

Written consent from the model's creator, owner, and applicable IP rights holder(s) is required before any external model will be accepted for use in commissioned work. G3 C&M reserves the right to request documentation of such consent at any time.

The client bears full responsibility for ensuring that any model they provide or link to is legally permissible for use in the commissioned work. G3 C&M reserves the right to refuse any model that does not meet these standards or for which proper licensing cannot be verified.

Bring Your Own Software (BYOS) & Anti-Piracy Policy

G3 C&M LLC uses the following licensed and open-source software in its creative and development workflow:

DaVinci Resolve, Canva, Affinity, Blender, Source Filmmaker, Godot, VS Code, GIMP, Krita, LibraSprite, OpenCode, WSL2, Windows 11 Pro, Ubuntu 24 LTS, Google Chrome, Firefox, VLC, Android Studio, Android SDK, GitHub, Docker

If a client requests the use of specific software that G3 C&M does not already hold a valid license for, the client must provide a legitimate license for that software before work can proceed.

G3 C&M strictly prohibits the use of pirated software for any creative or development work. We do not condone, support, or participate in software piracy in any form.

Any media, software, assets, or files provided by the client that are pirated or obtained unlawfully are the sole risk and responsibility of the client. G3 C&M LLC shall not be held liable for any damages, claims, or legal consequences arising from the client's submission of pirated or unlicensed materials. The client bears full responsibility for the accuracy and legality of all materials they provide, and G3 C&M LLC is not obligated to verify whether submitted materials are properly licensed.

Privacy Policy

1. Introduction

G3 C&M LLC ("we," "us," or "our") takes your privacy seriously. This policy outlines how we collect, store, use, and protect your information when you interact with our services, website, or commissions. Privacy is a top priority in all of our operations.

2. Data We Collect & Store

We collect and retain the following information for legal and operational purposes:

  • Signed contracts — Retained indefinitely for the protection of all parties involved.
  • Conversation records — All project-related communications are documented for legal protection and project continuity.
  • Contact information — Name, email address, and any other details you provide during the commission process.
  • Payment records — Invoices and payment confirmations for accounting and legal purposes.

3. How We Use Your Data

  • To fulfill commissioned work and provide project updates.
  • To maintain legal records (contracts, communications, payment history).
  • To communicate with you regarding your project or inquiries.
  • To comply with applicable legal obligations.

We do not use your data for marketing, advertising, or profiling purposes.

4. Data Sharing & AI Training

G3 C&M LLC does not sell, rent, or trade your personal data to third parties. We have no plans or intent to use client data for any form of AI training, machine learning, or dataset creation. Your conversations, contracts, project materials, and personal information are strictly used for the purposes outlined in Section 3.

We will never share your data with third parties except where required by law or with your explicit written consent.

5. Generative AI Policy

G3 C&M LLC maintains a strict zero-tolerance policy for generative AI in the following areas:

  • Artwork, character designs, or visual media of any kind.
  • Sound design, music, or voice generation.
  • Commissioned assets, placeholders, or concept work.
  • Core game mechanics, systems, or narrative content.
  • Any AI-generated imagery for game projects or portfolio work.

The only exception is the use of AI-assisted tools within code editors (such as code completion or debugging suggestions) in restricted, privacy-respecting environments. This is used strictly for streamlining development when necessary — never for creative or artistic output. We are against generative AI in art and media creation and will not use it in any client-facing or creative capacity.

6. Third-Party Software & AI Features

G3 C&M LLC uses a variety of licensed third-party software tools in its workflow. We cannot guarantee that these tools do not contain baked-in AI features or algorithms outside our control. Examples include:

  • Affinity — Inpainting and other AI-assisted editing features.
  • DaVinci Resolve — Upscaling algorithms and AI-enhanced tools.
  • Game engines — Technologies such as FSR (FidelityFX Super Resolution) and similar upscaling or AI-driven features.
  • Any other licensed software that may incorporate AI features beyond our control.

The presence of these features in third-party software is outside G3 C&M's control and does not reflect our own AI policies. We do not actively use these features for creative generation unless they are standard, non-generative tools integrated into the software's core functionality.

7. External Platform Data Leaks

G3 C&M LLC communicates and operates through various external platforms and services, including but not limited to X/Twitter, Canva, email services, PayPal, and other third-party tools. We cannot prevent or be held liable for data leaks, security breaches, or policy changes that occur on these external platforms.

By engaging with G3 C&M LLC, you acknowledge and accept that:

  • Any data leak, security incident, or privacy compromise originating from an external platform or third-party software is outside G3 C&M's control.
  • G3 C&M LLC shall not be held liable for data leaks caused by external platforms (e.g., X/Twitter DM breaches, Canva security incidents) or for accidental mishaps on these platforms.
  • The risk of using external platforms and third-party software rests with the client and the platform user.

8. DRM & Software Distribution

G3 C&M LLC develops and distributes software and games with a strong commitment to user privacy. We have no plans to implement additional DRM (Digital Rights Management) measures beyond what is required by the distribution platforms we use, such as Steam by Valve.

Our games and software are intended to be DRM-free wherever possible. We believe that paying customers should not be burdened with unnecessary restrictions on the software they own, and we respect your right to privacy and offline access to the content you have purchased.

If any platform we distribute on requires DRM as a condition of publishing, we will use the minimum necessary to comply and will clearly disclose this to our users.

Fair Use Notice

Some content displayed on this website — including but not limited to character depictions, references, and commentary — may be used under the Fair Use doctrine as defined in Section 107 of the U.S. Copyright Act. This includes uses for purposes such as criticism, comment, education, parody, and portfolio demonstration. If you believe any content does not qualify as fair use, please contact us.

Non-Refundable Deposit & Labor Policy

All commission work by G3 C&M LLC operates on a 50% upfront deposit, 50% on completion payment structure. The initial 50% deposit is non-refundable under any circumstances.

This deposit covers the cost of consultation, project planning, communication, and all labor rendered before the second payment is made. "Labor rendered" includes, but is not limited to: research, asset preparation, pipeline and file setup, initial creative work, drafting, project management, and any other billable time invested in the project. The deposit also covers administrative overhead (invoicing, contract processing, file organization, correspondence) and opportunity cost — the act of reserving time on the project schedule prevents G3 C&M LLC from accepting other paying clients during that period. By submitting the first payment, the client acknowledges that this deposit secures their place in the work queue and compensates G3 C&M LLC for time and resources committed to their project up to that point, regardless of whether the project is completed or cancelled by the client after work has begun.

No refunds will be issued for the deposit portion. The second 50% payment finalizes the project and delivers the finished work. Any changes requested after the second payment has been made require a new commission with a new deposit. Full commission terms are available on the Commissions page.

Right to Refuse Service & Content Ethics Policy

1. Ethics & Legal Compliance

G3 C&M LLC reserves the right to refuse service to any individual or project that involves content that is unethical, illegal, violates the Geneva Convention, or depicts minors in explicit or illegal activities. We maintain a strict focus on consenting adults in all commissioned work. No amount of context can override the rule of legal and ethical compliance first.

2. Open-Minded & Anti-Discrimination

We are open-minded toward expressive LGBTQ+ content and media and are anti-discrimination within the description of applicable U.S. laws (Indiana). We accept commissions involving consensual explicit themes, including but not limited to consensual BDSM works, dating games, and adult media as standalone projects or within game development.

3. Dark Humor Policy

Dark humor is permitted to varying degrees but is evaluated on a case-by-case basis during the consultation phase. Any dark humor content must be disclosed up front — the client must provide a script or a list of dark humor lines for approval before implementation. G3 C&M reserves the right to deny any dark humor element at its sole discretion.

4. Refusal & Payment

If a commission or project violates any of the laws or ethics outlined above, we will flatly refuse the project entirely — no payment will be accepted. The consultation cost (quote preparation, time, and communication) is absorbed by G3 C&M as a loss to remain in full compliance with the law and our ethical standards.

5. Client Jurisdiction & Responsibility

The client bears full responsibility for ensuring that the commissioned media or game is legal in their area, state, or country. If the project is illegal in their jurisdiction, that is solely the client's responsibility. Knowingly providing false information about the legality of a project is treated as perjury and is the sole responsibility of the client.
